Petitioners seek bail in a case registered under sections 399, 402 of the Indian Penal Code and 25(1-b)a 26/35 of the Arms Act. Prosecution case, in short is, that on the basis of confidential information senior police officer the informant along with other police force arrived at Railway Halt Gospur and saw four youths got down from the Rampur Hat Gaya passengers train and on seeing the police force the aforesaid four persons started trying to flee away but out of them three were arrested and one succeeded in fleeing away. The arrested persons disclosed their names as Nawal Kumar, Saurabh Kumar and Sonu Kumar Sao and on search one loaded pistol along with two live cartridges and a mobile phone were recovered from the petitioner Nawal Kumar, one loaded country made pistol along with one live cartridge and two mobile phone from

No.21020 of 2015 (2) dt.13-07-2015 2/2 the petitioner Sonu Kumar Sao and one country made pistol along with two live cartridge and two mobile phones were recovered from accused Saurabh Kumar and when asked them to produce the documents about the aforesaid arms and mobile phones they did not produce any document and accordingly seizure list were prepared.

On behalf of the petitioners it has been submitted that petitioners have no criminal antecedents and charge sheet has been submitted in the case. It is further submitted that from the possession of the petitioners one loaded country made pistol and one cartridge have been recovered. Petitioners are in jail custody since 29.01.2015. On behalf of the State it is submitted that petitioners are named in the first information report.

Considering the aforesaid facts, let the above named petitioners be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in Warsaliganj P.S. Case No. 24 of 2015.
