Petitioner seeks bail in a case registered under sections 452, 354 of the Indian Penal Code.
Prosecution case, in short, is that the informant was sleeping after taking meal in her house on 26.11.2014. The gate of the informant was made by bamboo and the same was tied up with rope. At 9.30 P.M. her villager namely Dinesh Choudhary aged about 30 years entered in the house of informant and caught her hand. Then she was awoke up and she identified him in light and raised alarm then her father-in-law Yogendra Bhagat , Bhaisur and Dewar also awoke . Dinesh Choudhary fled away to see them. In the meantime she clashed in pillar and he received

It is submitted on behalf of the petitioner that petitioner is in custody since 10.03.2015. Charge sheet in this case has been submitted. It is further submitted that petitioner has no criminal antecedent. It has further been submitted that petitioner has been made accused due to mistake of fact. On behalf of the State it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in Barauli P.S.
