Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Runnisaidpur P.S. Case No. 162 of 2020, registered for the offences punishable under Sections 341, 323, 324, 379, 307, 447 and 34 of the Indian Penal Code.
As per allegation, the accused persons assaulted the informant and her husband as they were not opening shop on the asking of the accused persons, due to lockdown. Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.15466 of 2021(2) dt.17-01-2022 2/2 injury sustained by the husband of the informant is simple in nature and caused by hard and blunt substance has mentioned in the lower court's order. He has also mentioned that the lower court's order shows itself that no injury report of the informant has produced by the prosecution in spite of several opportunities provided therefor.
Considering the above-mentioned facts and circumstances, let the petitioner be released on anticipatory bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Sitamarhi in connection with Runnisaidpur P.S. Case No. 162 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
