JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-04-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bagengola P.S. Case No. 05 of 2017 registered for the offences punishable under Sections 147, 149, 341,323 448, 302, 504, 506 of the Indian Penal Code.

As per the prosecution case, this petitioner along with co-accused Satendra Singh caught hold of the mother of the informant and co-accused Kamleshwar Singh assaulted the mother of the informant by lathi, as a result of which she died on the spot.

Learned counsel appearing for the petitioners submits that petitioner has falsely been implicated in this case.

No.6728 of 2023(2) dt.17-04-2023 2/2 It is submitted that specific accusation of assault is against Kamleshwar Singh and the police after investigation submitted final form against this petitioner, has not found the case true. Similarly situated co-accused Satyendra Singh @ Sonu has been granted privilege of anticipatory bail by this Court vide order dated 03.04.2023 passed in Cr. Misc. No. 3784 of 2023. Petitioner claims clean antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Additional Sessions Judge, IV, Buxar in Bagengola P.S. Case No. 05 of 2017 subject to condition as laid down under Section 438(2) of the Cr.P.C.
