The petitioner apprehends his arrest in a case registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner and coaccused Dharmendra Singh caught hold the mother of informant and co-accused Kamleshwar Singh assaulted the mother of informant by lathi, as a result of which she died on the spot. It is submitted that petitioner has been falsely implicated in this case. Specific accusation of assault is against co-accused Kamleshwar Singh and the police after investigation submitted chargesheet vide chargesheet No. 33/17 on 30.06.2017 and has not found the case true against the

Patna High Court CR. MISC. No.3784 of 2023(2) dt.03-04-2023 2/2 petitioner. Petitioner claims clean antecedent. Counsel for informant however vehemently opposed the prayer for bail.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge IVth, Buxar in connection with Bagengola P.S. Case No. 05 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
