====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 07-09-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offence punishable under Section 395 of the I.P.C. According to FIR, dacoity in bank was committed by unknown criminals.

Submission is that name of the petitioner surfaced in the confessional statement of co-accused. Petitioner is in custody since 28.07.2020, however, he was never put on test identification parade during investigation of the case nor any incriminating article has been recovered from possession of the petitioner. Some other co-accused standing on similar footing have already been allowed bail by a co-ordinate Bench of this Court.

No.14278 of 2021(3) dt.07-09-2021 2/2 Considering entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Motipur P.S. Case No. 41 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
