JUSTICE SHIVAJI PANDEY ORAL ORDER 17-06-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in Rajauli P.S. Case No.32 of 2015 instituted for the offences under Sections 376 of the Indian Penal Code, Section 4 of POCSO Act and Section 3(XII) of SC/ST Act.

As per the First Information Report and the statement of the victim the petitioner has forcibly committed rape upon her.

Learned counsel for the petitioner submits that medical report does not support the case of the prosecution and as such the petitioner may be released on bail. Statement made under Section 164 of the Code of

Patna High Court Cr.Misc. No.20285 of 2015 (2) dt.17-06-2015 criminal Procedure corroborates the statement made in the First Information Report.

Looking to the nature of allegation, this Court is not inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected. However, the court below is directed to expedite the trial.
