1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Jalalpur Police Station Case No. 220 of 2024, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
3. As per the FIR, on 22.09.2024, informant received secret information that petitioner is selling liquor from bush beside his house. When informant reached at the place of occurrence then two persons on seeing the police vehicle started fleeing away carrying plastic bag in their hand. Informant tried to catch them with the help of other police officials but they succeeded in fleeing taking advantage of darkness after
Patna High Court CR. MISC. No.3143 of 2025(3) dt.19-02-2025 2/3 throwing the bags. Upon search of the plastic bags total 47 liters of country made liquor was recovered.
4. Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated on the basis of secret information. Nothing has been recovered from the conscious possession and/or premises belonging to the petitioner.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that petitioner has been implicated on the basis of secret information and the place of recovery of illicit liquor is a bush situated beside the house of the petitioner which is an open space accessible to everyone, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of 2nd Exclusive Special Exicse Judge, Saran at Chapra, in connection with Jalalpur Police Station Case No. 220 of 2024, subject to the condition laid
