JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 16-09-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the complainant/informant.

The petitioner seeks bail in connection with Gopalganj Town P.S. Case No.225 of 2013 registered under Sections 406, 420 and 467 of the Indian Penal Code.

The accusation is of the complainant/informant, Sanjay Kumar Sharma, is of giving Rs.75000/- to the petitioner for preparation of Passport and Viza for sending him to Kuwait fixing the date for moving to Kuwait from Delhi on 13.06.2012 but neither on that date the Passport nor the Viza had been handed over to the

Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner and other persons had approached Md. Sheikh Afzal, Proprietor of Arman International, for sending the complainant/informant and others for sending them to Kuwait and money was handed over to him in time for preparation of Passport and Viza by the Arman International. Thereafter, the complaint was lodged by the petitioner against Md. Sheikh Afzal, Proprietor of Arman International and the complainant/informant and others. Thereafter, the petitioner paid Rs.43000/- through Md. Sheikh Afzal, Proprietor of Arman Inter to the complainant/informant and took his signature on the stamp paper with further statement that rest amount would be given later on and in case the remaining money is not paid, he will paid double money of the same.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj Town P.S. Case No.225 of 2013.
