JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-04-2023 The present writ petition has been filed seeking the following relief:- "1.That this is an application for issuance of an appropriate writ, order or direction, directing the Respondent/ District Magistrate, Banka to enquire into the allegation of illegal construction by Private respondents over the land of the petitioner having an area of 5 1⁄2 Dc. Bearing Khata no. 456 (New) 147/31 (Ka) Old

Patna High Court CWJC No.3026 of 2017(2) dt.11-04-2023 2/2 R.S. Plot no. 146/203, 204 C.S. Plot No. 74 situated in Mauza-Panjwara, for which the petitioner has filed representation on 20.12.2012 as well as on 31.01.2017 and private respondents be restrained from making construction over the said land till the conclusion of enquiry and disposal of case.

And for any other reliefs for which the petitioner is found entitled in the facts and circumstances of the case."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
