The learned counsels are appearing and making submissions from their residence. The Court Master and Secretary are also part of this virtual court proceedings from their homes, all with the aid of audio visual technology.
Heard learned Counsel for the petitioners and the learned Counsel for the State as also the learned counsel appearing for the complainant.
Petitioner apprehends arrest in Complaint Case No. 1760 of 2018, T.R. No. 2514 of 2019 registered under Sections 406, 420 of the IPC and Section 138 of the N.I.Act.
Learned Counsel for the petitioners submits that the
Patna High Court CR. MISC. No.7609 of 2020(2) dt.08-07-2020 2/2 petitioners would make payment of Rs. Two lakhs to the complainant, which as per the impugned order was tendered by them in the court below, for grant of privilege of anticipatory bail. In the event the petitioners, above named, appear before the court below, i.e. the Court of Judicial Magistrate, lst Class, Samastiupur in connection with Complaint Case No. 1760 of 2018, T.R. No. 2514 of 2019 within 4 weeks with a demand draft of Rs. Two lakhs, the court below shall release the petitioners on bail. It is made clear that this payment would be without prejudice to the right of either parties in respect of the disputed amount.
The application stands disposed of.
