The petitioner seeks bail in connection with C2 Case No. 505 of 2021 instituted for the offences under Section 30(a) of the Bihar Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 30.10.2021, is a person with clean antecedent and prosecution report has been submitted in the case.
Learned counsel for the petitioner submits that the allegation is of recovery of 74 litres of liquor from a bag kept on a motorcycle.
Learned counsel for the petitioner submits that the

No.4522 of 2022(2) dt.07-03-2022 2/2 petitioner had parked the motorcycle and had gone to a shop when it appears that the miscreants on seeing the police fled away leaving the bag on the motorcycle of the petitioner. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent and prosecution report has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise Act, Sitamarhi in connection with C2 Case No. 505 of 2021.
