JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-04-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Madhubani Town P.S. Case No. 192 of 2022 registered for the offences punishable under Sections 341, 323, 307, 354(B), 379, 506/34 of the Indian Penal Code .

As per the prosecution case, the allegation against the petitioner is that she along with other co-accused persons abused and assaulted the informant's wife and mother. It is submitted by the learned counsel for the petitioner that she is innocent and has falsely been implicated in this case. Due to land dispute, scuffle took place between the parties. Both the parties are Gotiyas. The

Patna High Court CR. MISC. No.4014 of 2023(2) dt.03-04-2023 2/2 injury sustained by the petitioner's husband found to be simple in nature.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in Madhubani Town P.S. Case No. 192 of 2022 subject to condition as laid down under Section 438(2) of the Cr.P.C.
