2. The petitioners seek bail in a case registered for the offence punishable under Sections-19(c)(vi) of Fertilizer Control Order, 1985, 7 of Essential Commodities Act, 103 of Trade Mark Act-1999 and under Sections 338, 336(3), 341(1), 318(4) of B.N.S. Act.

3. Allegedly, spurious fertilizers are said to have been recovered from the house of the accused persons.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The spurious fertilizers were not

Patna High Court CR. MISC. No.5514 of 2025(2) dt.19-02-2025 2/2 recovered from house of the petitioners rather it was recovered from the house of co-accused Prince Kumar. So far as petitioners are concerned, one packet of rock iron oxide was kept by petitioners at the flour mill for the purpose of cleaning the machine and filter of water. The petitioners are in custody since 20-10-2024.

5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate/concerned court, Samastipur in connection with Kalyanpur P.S. Case No. 281 of 2024 with condition that the petitioners shall cooperate with the trial of the case and make themselves available as and when required by the court.
