JUSTICE SANJAY PRIYA ORAL ORDER 10-02-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in Bhore P.S. Case No.129 of 2016 instituted for the offence under Sections 341, 342, 504, 323, 324 and 307/34 of the Indian Penal Code. As per the written report, there is specific allegation against co-accused Upendra Baitha of assaulting the daughter of informant with farsa on her head on account of which blood started oozing. In the written report there is general and omnibus allegation against all the accused persons.
It has been submitted that there is a case and counter case. Son of petitioner no.4 has lodged a case bearing Bhore P.S.
Patna High Court Cr.Misc. No.4381 of 2017 (2) dt.10-02-2017 Case No.130 of 2016 for the same day of the occurrence. In view of such, prayer of the petitioners for anticipatory bail is allowed.
In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Bhore P.S. Case No.129 of 2016, they shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Gopalganj, subject to the conditions as laid down under Section 438(2) Cr.P.C.
