JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code. The name of petitioner came in confessional statement of co-accused, Rajan Choudhary and admittedly, nothing has been recovered from conscious possession of the petitioner nor petitioner has been identified by the informant in Test Identification Parade. No doubt, petitioner carries criminal antecedent but in the present case, there appears to be nothing against him.

Considering the aforesaid facts and circumstances as

No.11415 of 2016 (2) dt.15-03-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri B.K. Ray, Additional Chief Judicial Magistrate-II, Bettiah, West Champaran in connection with Yogapatti P.S. Case No. 275 of 2015.
