JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-03-2026 Heard learned counsel appearing on behalf of the petitioners, learned APP appearing on behalf of the State and learned counsel appearing on behalf of the informant.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 103(1) and 3(5) of the B.N.S. and Section 27 of the Arms Act.
3. As per prosecution case, it is alleged that these two petitioners dragged grandfather of the informant out of his vehicle and thereafter, co-accused Anant Singh shot grandfather of the informant as a result of which, he died.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.5212 of 2026(3) dt.30-03-2026 2/3 behalf of the petitioners that petitioners are quite innocent and have committed no offence. Petitioners have falsely been implicated in this case due to political rivalry. As a matter of fact, on the alleged date and time of occurrence, these petitioners were peacefully accompanying the election campaign convoy of co-accused Anant Singh and the convoys of both the political parties accidentally came face to face, resulting in a spontaneous verbal hot talk exchanged between supporters of both the sides. The alleged incident took place spontaneously and there is no premeditated conspiracy or common object attributed to these petitioners. It is further submitted that petitioners are not alleged to have committed any overt act. They are only alleged to have dragged the deceased out of the vehicle and thereafter, co-accused Anant Singh shot the deceased, who has already been granted regular bail by a Co-ordinate Bench of this Hon'ble Court vide order dated 19.03.2026 passed in Cr. Misc. No. 835 of 2026.
5. On the other hand, learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the facts and circumstances of the case and general and omnibus nature of accusation, the prayer for
Patna High Court CR. MISC. No.5212 of 2026(3) dt.30-03-2026 3/3 grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I-cumMps/MLAs Court, Patna in connection with Bhadaur P.S. Case No. 110 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S..
