JUSTICE SUDHIR SINGH ORAL ORDER 17-07-2015 The petitioner is languishing in jail custody since 3.3.2015 in connection with Brahmpura P.S. Case No.208 of 2014 ( S.T.No.38 of 2015) registered for the offences under Sections 363/365 and 364(A) of the I.P.C.

Heard learned counsel for the petitioner learned counsel for the State.

The prosecution case, in brief, is that on 21.9.2014 at about 7 P.M. her husband Satyanarayan Prasad along with one staff Mukesh Kumar left the house for collection of money of the business of mustered oil by Indica car but he did not return. It is further stated that the informant made a search and tried to contact on mobile but it was found switched off. Today the matter was informed to the Senior Superintendent of Police and in search the said Indica car was found in abandoned condition near over bridge of Sitamarhi road in which some articles of her husband was found

Patna High Court Cr.Misc. No.20439 of 2015 (3) dt.17-07-2015 2/2 which was identified by the informant and suspicion was raised that some persons have kidnapped her husband and staff for ransom.

It has been submitted on behalf of the petitioner that he is not named in the F.I.R.It has further been submitted that the name of the petitioner appeared in the present case in course of investigation. It is further submitted that the other co-accused persons have already been granted bail vide Cr.Misc. Case no.8973 of 2015 and Cr.Misc. No.14184 of 2015. It has been submitted that chargesheet has been submitted in the present case and the petitioner is in custody since 3.3.2015. On behalf of the State it has been submitted that though the name of the petitioner has appeared in course of investigation but the petitioner has got criminal antecedent. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned 5th Additional Sessions Judge, Muzaffarpur, in Brahmpura P.S. Case no.208 of 2014 (S.T. No.38/15).
