JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 3⁄4 of Explosive Substance Act and Section 17 of C.L.A. Act.

Petitioner is named in the first information report at serial no. 22 but the informant has raised only suspicion against him and admittedly, nothing was recovered from conscious possession of the petitioner. Moreover, petitioner is in jail custody since 17.12.2015 and does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.11933 of 2016 (2) dt.17-03-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 87 of 2014.
