The petitioners have preferred the instant application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per allegation in the F.I.R., 396 litres of liquor was recovered from a bolero pickup van and the two petitioners were taken into custody.

It is submitted by learned senior counsel for the petitioners that no incriminating article has been recovered from the possession or vehicle of the petitioners. They have been falsely implicated in the case. The petitioners are in custody

Patna High Court CR. MISC. No.14169 of 2021(3) dt.24-08-2021 2/2 since 20.12.2020 and have no criminal antecedents. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case together with the report received from the Superintendent of Police, Purnea of the petitioners not having any criminal antecedents, this Court directs the petitioners to be enlarged on bail in connection with Purnea Excise C-1 Case no.232 of 2020 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Purnea.
