The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 36 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 210 litres of liquor was recovered from the tempo and the petitioner who was the driver of the vehicle was taken into custody.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the possession of the petitioner and he has been falsely implicated in the case. He has no criminal antecedent and is in custody since 7.11.2021. Charge sheet has been submitted in the case. Heard learned APP for the State.

Having heard learned counsel for the parties and

No.4773 of 2022(2) dt.20-04-2022 2/2 taking into consideration the nature of allegation, the petitioner not having any criminal antecedent, having remained in custody for more than 5 months and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Special Case no. 7195 of 2021 (arising out of Didarganj P.S. Case no. 229 of 2021) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna.
