JUSTICE RAKESH KUMAR ORAL ORDER 03-05-2016 The sole petitioner, has approached this court invoking its inherent jurisdiction under Section 482 of the Code of Criminal Procedure with a prayer to quash an order dated 3.6.2013 passed by learned Adhoc Additional District Judge III, Munger in S.C.- 138 of 2013 arising out of Kasim Bazar P.S. Case No. 217 of 2012 instituted under section 25( 1-A)(A), 26(i), (ii), 35 of the Arms Act and Section 4 / 5 of the Explosive Substances Act and Section 17 / 20 of the U.A.P.A. Act. By the said order the learned court below has rejected the discharge petition filed by the petitioner.
Sri Jharkhandi Upadhyaya, learned A.P.P. submits that in search huge quantity of arms and ammunitions were recovered which includes 35 detonators.
Patna High Court Cr.Misc. No.30483 of 2013 (2) dt.03-05-2016 2/2 Besides hearing, I have also perused the materials available on record. I do not find any defect in the impugned order warranting interference.
The petition stands dismissed.
