1. Heard the parties.

2. The petitioner seeks regular bail in connection with Sangrampur P.S. Case No. 35 of 2024 dated 11.02.2024 registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. The prosecution case as per the first information report is that the Police on secret information that illicit liquor is being manufactured and sold in the village- Koirgawan, Bintoli, proceeded towards the village and on seeing the Police, some persons fled away. The local Chowkidar disclosed the name of the petitioner and other accused persons who fled away from the place of occurrence. On search, Police recovered 57 liters of illicit country made liquor kept in front of the house of the

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of disclosure of his name by the local Chowkidar. He further submits that the petitioner is not the owner of the motorcycle in question and the petitioner is not having any connection with the co-accused / Chandrama Mahto. The petitioner is in custody since 19.11.2024.

5. Regard being had to the submissions made by the parties, taking into consideration the nature of allegation and the period of custody, I am inclined to grant regular bail to the petitioner.

6. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 01, East Champaran at Motihari in connection with Sangrampur P.S. Case No. 35 of 2024.
