JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2020 This is an application for grant of anticipatory bail in connection with Aurai P. S. Case No. 284 of 2019, disclosing offences under Section 272, 273/34 of IPC and Sections 30(a)/38(i)/38(ii) of the Bihar Prohibition and Excise Act, 2016. Recovery of huge quantity of liquor, i.e., 667.05 liters from the Bolero vehicle of the petitioner and two persons succeeded in fleeing away from the spot.

Submission of the learned counsel for the petitioner is that he was not present there. He has falsely been implicated in this case. He has no criminal antecedent.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground of recovery of huge quantity of liquor from the vehicle of the petitioner.

No.2500 of 2020(2) dt.24-01-2020 2/2 Having heard both sides, in view of the allegation and quantity of liquor recovered from the vehicle of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail.
