Mr. Jharkhandi Upadhyay, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 14-09-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offence punishable under Sections 341/323/307/504/506/34 of the Indian Penal Code. Later on offence under Section 302 of the Indian Penal Code was added.

Co-accused Shivraj Chaudhary is assailant of the deceased and at the time he was assaulting with Tangi, the petitioner and co-accused were keeping hold on the deceased. Submission is that similarly situated co-accused Ranjeet Chaudhary has been allowed bail by a coordinate Bench of this Court in Cr. Misc. No. 24336 of 2020. Considering the facts aforesaid and completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand)

Patna High Court CR. MISC. No.14374 of 2021(3) dt.14-09-2021 2/2 with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Parasi P.S. Case No. 56 of 2019 with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
