2. The petitioner seeks regular bail in connection with Bodh Gaya P.S. Case No. 139 of 2023 registered for the offence under Sections 341, 323, 447, 354, 379 and 506 / 34 of the Indian Penal Code and Sections 8 and 12 of POCSO Act.
3. As per the prosecution case, the allegation against the petitioner is that he has outraged the modesty of a minor girl.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. He is in judicial custody since 24.11.2023. The petitioner has no criminal antecedent as stated in para 3 of the
Patna High Court CR. MISC. No.6252 of 2024(2) dt.16-02-2024 2/2 petition.
5. However, learned APP for the State vehemently opposed the prayer for regular bail.

Having heard learned counsel for the parties, perused the F.I.R. and impugned order dated 13.12.2023 passed by learned Special Judge, POCSO- cum- Additional District and Sessions Judge - VI, Gaya it appears that total 18 accused have committed offence under Sections 341, 323, 447, 354, 379 and 506/34 of the Indian Penal Code and Sections 8 and 12 of POCSO Act. Considering the aforesaid facts and circumstances, the above named petitioner is directed to be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO-cum- Additional District and Sessions Judge - VI, Gaya in connection with Bodh Gaya P.S. Case. 139 of 2023.
