JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Garhpura P.S. Case No. 3 of 2021 corresponding to Sessions Trial No. 498 of 2021, registered for the offence punishable under Section 392 of the Indian Penal Code in which after investigation charge sheet has been submitted u/s 394, 397, 411 of the IPC. It is a case of road robbery wherein on the point of gun, one pickup van was robbed.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner surfaced in this case on the basis of confessional statement of co-accused Abhikant Kumar @ Lalbabu Yadav, who has already been granted bail by this court vide order dated 10.03.2022 passed in Cr. Misc. No.

Patna High Court CR. MISC. No.4618 of 2022(2) dt.01-04-2022 2/2 72159/2021. No looted article has been recovered from possession of this petitioner. Till date petitioner has not been put on test identification parade. Petitioner is in custody since 16.08.2021. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-XIV, Begusarai in connection with Garhpura P.S. Case No. 3 of 2021 corresponding to Sessions Trial No. 498 of 2021.
