The petitioner is languishing in custody since 31.12.2014 in a case registered for the offences punishable under Sections 341, 323, 420, 379, 504, 506/34 of the Indian Penal Code and 3(1) (x) of SC/ST (Prevention of Atrocities) Act. It is alleged that the informant the Secretary of Shivalik Rural Development and Women Welfare Society and the petitioner used to work as a labour in the said society. It is alleged that fraudulently the petitioner and one Bajrangi Singh took Rs.Four lakhs from the society.
It is submitted by learned counsel for the petitioner that the informant with the same sets of facts filed
Patna High Court Cr.Misc. No.14240 of 2015 (02) dt.27-04-2015 2/2 Complaint Case No. 870C of 2011 against co-accused Bajrangi Yadav and his daughter. The daughter of the petitioner filed Buxar P.S. Case No. 51 of 2014 making accusation under Section 376/511 of the IPC against the informant, hence, as a pressure tactics the present case has been lodged. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent and co-accused Bajrangi Singh has been bail vide Cr. Misc. No. 31344 of 2014.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar SC/ST P.S. Case No. 01 of 2014. (Dinesh Kumar Singh, J) DKS/- U T
