2. Petitioner seeks regular bail in connection with S.T. No. 513 of 2023 arising out of Ghorasahan (Jitna) P. S. Case No. 463/2021 in a case registered for the offences punishable under Sections 147, 148, 149, 447, 448, 341, 342, 307, 364, 302, 120B of the Indian Penal Code and Sections 25(1-b)a, 27, 35 of Arms Act .

3. It is alleged that on 25.10.21 at about 6:45 PM, all the F.I.R. named accused persons including this petitioner and 6-7 unknown persons, variously armed, came at the door of informant and assaulted her husband and other family members as a result of which husband of the informant, who sustained

Patna High Court CR. MISC. No.3601 of 2025(2) dt.05-03-2025 2/3 gunshot injury, died during course of treatment. Reason behind the occurrence is love marriage of the informant with the deceased who were co-villagers.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Allegation of assault against informant is general and omnibus and there is no specific allegation of overt act against him. It is further submitted that similarly situated co-accused persons have already been granted bail by this Hon'ble Court vide order dated 01.12.2023 passed in Cr. Misc. No. 73693 of 2023. Petitioner is in custody since 16.08.2024. Charge-sheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the nature of accusation, period of custody and other facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 16th Additional Sessions Judge, East Champaran, Motihari in connection with S.T. No. 513 of 2023 arising out of
