2. The petitioner seeks regular bail in a case registered for the offence punishable under sections Section 341, 323, 379, 467, 468, 471, 385, 506/34 of the Indian Penal Code . 3 . As per the prosecution case , this petitioner who is Nandosi of the deceased tried many times to commit rape with the deceased, and when did not succeed, he along with other coaccused persons under conspiracy committed murder of the deceased, and the dead body was buried with a view to conceal the evidence .

4. Learned counsel for the petitioner submits that petitioner is quite innocent and has falsely been implicated in this case only on the basis of suspicion . F.I.R., has been lodged after the delay of 4 days for which there is no plausible explanation . There is no eye witness to the alleged occurrence . As a matter of fact, deceased herself committed suicide due to her family dispute and petitioner has got no concern with the alleged occurrence . Post mortem report, reveals that no internal or external injury was found upon the body of deceased and the cause of death is "asphyxia due to hanging". After thorough investigation , police submitted chargesheet under sections 306, 201 and 34 of the Indian Penal Code . Petitioner is in custody since 24.10.2024 .
5 . Learned counsel for the State opposes the prayer for bail.
6. Considering the aforesaid facts of the case , period of custody and other circumstances of the case , prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM West Champaran at Motihari in connection with Ram Nagar P. S. Case No. 383
