JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner was neither caught on the spot nor anything was recovered from his conscious possession and so far as the land from which, opium was seized, does not belong to the petitioner because nothing has been brought by the prosecution to show that the aforesaid land belongs to the petitioner.

No doubt, the petitioner carries criminal antecedent but prior to institution of the present case, no case under the provisions of NDPS Act had been registered against him.

Accordingly, the petitioner named above, is

No.22927 of 2015 (2) dt.08-07-2015 2/2 directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with NDPS Case No. 04 of 2011 arising out of Dighawara P.S.
