The petitioner seeks regular bail in connection with Lakhisarai Ramgarh Chowk P.S. Case No. 826 of 2019, for the offence punishable under Sections 341, 323, 308, 504/34 of the Indian Penal Code.
The allegation is regarding altercation having taken place in between the petitioner and the informant and his family members on account of dispute regarding tying of the cow, whereafter the petitioner is stated to have assaulted the wife of the informant.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent
Patna High Court CR. MISC. No.3378 of 2020(2) dt.20-01-2020 2/2 and is languishing in custody since 18.11.2019. It is also submitted that the injury, if any, found on the person of the wife of the informant is stated to be simple in nature. Having regard to the facts and circumstances of the case, considering the submissions advanced by the learned counsel for the petitioner coupled with the fact that the petitioner is having a clean antecedent and a general and omnibus allegation has been levelled against the petitioner herein, I deem it fit and proper to direct for release of the petitioner on regular bail.
Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai Ramgarh Chowk P.S. Case No. 826/19 of 2019.
