The petitioner is in custody since 24.11.2014 on surrender in connection with Forbesganj (Simraha) P.S. Case No.729 of 2014 registered for the offences under Sections 395 and 412 of the Indian Penal Code.
Learned counsel for the petitioner submits that though the petitioner is not named in the F.I.R. and has nothing to do with the occurrence of Bank dacoity, still his name has been included on the basis of the confessional statement of co-accused Md. Anwar Alam, which has no evidentiary value. It is further submitted that nothing has been recovered either from the house of the petitioner or from his possession, but the police has
Patna High Court Cr.Misc. No.20849 of 2015 (2) dt.26-05-2015 2/2 mischievously shown the recovery of looted money and mobile, which are said to have been planted by the police themselves. It is further submitted that the petitioner has not been put on T.I. Parade, though he is languishing in jail since 24.11.2014. Considering the aforementioned facts and circumstances and also the fact that other similarly situated coaccused Chandan Kumar Rajbhar has been extended the privilege of bail in Cr. Misc. No.10515 of 2015, vide order dated 23.3.2015 as stated in paragraph 13 of the petition, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Forbesganj (Simraha) P.S. Case No.729 of 2014, G.R. No.3854 of 2014.
