This application, for grant of anticipatory bail, arises out of Khagaria Police Station Case No. 555 of 2020, disclosing offences under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code.
As per FIR, the accused persons after forming unlawful assembly assaulted the members of informant's side. The allegation against the petitioner is that he assaulted Arun Prasad, the father of the informant with lathi. The learned counsel for the petitioner has submitted that both the parties are agnates and there is land dispute
Patna High Court CR. MISC. No.14208 of 2021(2) dt.12-01-2022 2/2 between the parties and the injury sustained by Arun Prasad which is annexed as Annexure-2 are simple in nature caused by hard and blunt substance.
Learned Addl. P.P. has opposed and the prayer for bail.
Considering the aforementioned fact and circumstances, let the petitioner, named above, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria Police Station Case No. 555 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
