JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-02-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Kako P.S. Case No. 210 of 2019 for the offenses under Sections 341, 323,307, 353, 186, 504, 506 and 34 of the Indian Penal Code. Allegation against the petitioner is that he was involved in assaulting the informant-Headmaster Incharge of the school raising protest against organization of circus in the school campus.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The nature of injury sustained by the informant is simple. The petitioner is in custody since 11.11.2019.

Considering the totality of the fact situation, let the

Case No. 210 of 2019, subject to the condition that the petitioner shall not, in any manner, take steps for any kind of circus or exhibition in the school premises without prior permission of the district administration.
