2. This is the second attempt on behalf of the petitioner for grant of bail.

3. The petitioner seeks bail in connection with Mithanpura P.S.Case No. 384 of 2023 registered for the offence punishable under Section 304B/34 of the Indian Penal Code.

4. Petitioner is the husband of the deceased and he is alleged to have killed the deceased.

5. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It has been submitted by learned counsel for the petitioner Mr. Sanjay Kumar that the deceased committed suicide. The petitioner is in custody since 03.09.2023 and in the trial after

Patna High Court CR. MISC. No.4976 of 2026(2) dt.12-02-2026 2/2 examination of the witnesses an application under section 311 has been filed for examination of five more witnesses.

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

7. Considering the period of custody and delay in trial this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of the learned court below/ concerned Court in connection with Mithanpura P.S.Case No. 384 of 2023, subject to the condition that petitioner will co-operate in the trial.
