Petitioner seeks bail in a case registered under sections 25 (I-b)a, 25 (I-AA), 25 (I-AC), 26(i) (ii) (iii), 35 and 27 of the Arms Act.

Petitioner is in jail custody since 13.9.2015 on the accusation that he was found indulged in preparing illegal firearms and he was caught on the spot and one country made pistol was recovered from his conscious possession.

The contention on behalf of the petitioner is that petitioner was neither caught on the spot nor anything was recovered from his conscious possession and, as a matter of fact, he has been implicated in this case by the police. It is further stated that the petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as
