JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but according to the prosecution case itself, it was co-accused Shashi Yadv, who shot fire on the deceased. The reason behind the alleged occurrence is said to be previous quarrel between the deceased and petitioner as well as co-accused Shashi Yadav. Submission on behalf of the petitioner is that the petitioner has been roped in this case on mere suspicion and, moreover, even if prosecution story is assumed to be true, then also, except the allegation of member of mob, no any overt act has been attributed against the petitioner.

No.11495 of 2016 (2) dt.15-03-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S.Case No. 87 of 2016.
