The petitioners are apprehending their arrest in connection with Piprakothi P.S.Case No.168 of 2018 , registered for offences punishable under Sections 147, 148, 149, 341, 323, 307,380, 354 of the Indian Penal Code. Allegation against the petitioners is of assault by Danda and Farsa causing injury to the informant.
Submission of the learned counsel for the petitioners is that there is case and counter case and the persons from the petitioners' side have also received injuries and so far injuries are concerned, the injury report is not available with the petitioners but they have come to know that the injuries are simple in nature.
Patna High Court Cr.Misc. No.1266 of 2019(2) dt.18-01-2019 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, this application is disposed of with direction to the learned court below to verify the injury and if the injuries are simple in nature, he will release the petitioner on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran at Motihari in connection with Piprakothi P.S.Case No.168 of 2018, otherwise he is free to pass any other order or orders as deems fit and proper.
