JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the first information report but from perusal of the impugned order it would appear that petitioner was arrested by the police of Barawadih Police Station and informant of the present case allegedly, identified the petitioner in Barawadih Police Station. No doubt, petitioner carries criminal antecedent but his Test Identification Parade in the present case has not been held legally.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.12752 of 2016 (2) dt.28-03-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Navinagar P.S. Case No. 178 of 2014.
