JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-399, 402,307, 414/353 of the Indian Penal Code and under Sections-25(i-B)A/26/27/35 of the Arms Act. Petitioner and other accused were arrested by the police while they were assembled to make planning of bank dacoity and it is alleged that one country-made loaded pistol was recovered from conscious possession of the petitioner. Contention on behalf of the petitioner is that having more or less similar allegation, several co-accused have already been granted privilege of bail whereas; petitioner is in jail custody since 25-07-2015.
