The petitioner seeks bail in a case under Sections 302, 328 and other sections of the Indian Penal Code.
The informant alleged that his brother-in-law went to the house of Manjhi Rai to bring his wife who had illicit relation with Yogendra Rai, son of Manjhi Rai. He was found admitted in Sheohar hospital.
It is submitted that there is no eye-witness of the occurrence and nobody has seen the deceased came to the house of Manjhi Rai. The petitioner is the son of Manjhi Rai. Manjhi Rai has already been enlarged on bail vide Cr.Misc.No. 8267 of 2015 and the case of the petitioner stands on the same footing. Learned counsel for the informant, on the other hand,
Patna High Court Cr.Misc. No.20644 of 2015 (2) dt.17-06-2015 vehemently opposed the prayer for bail and submitted that the witnesses have stated that the petitioner and others killed the deceased.
There appears that there is no eye-witness of the occurrence. Manjhi Rai has already been enlarged on bail and the case of the petitioner stands on the same footing. Considering the facts aforesaid, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Subhash Chandra, Judicial Magistrate, 1st Class, Sheohar, in connection with Purnahiya P.S.Case No. 87/14.
