JUSTICE GOPAL PRASAD ORAL ORDER 07-04-2016 Heard the learned counsel for the petitioner, the informant and the State.

This is a petition for grant of regular bail for offence under Section 386/34 of the Penal Code.

It is alleged that ransom for rupees two lakhs was demanded and the matter was settled for Rs.60,500/-. However, the petitioner has criminal antecedent and there are three cases to his credit, one under Section 302 of the Penal Code, second under the Arms Act and third is under Section 394 of the Penal Code. Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Dandari P.S. Case No. 61 of 2015 to the satisfaction of the Additional Chief Judicial Magistrate, III, Begusarai, subject to the condition that one of the bailors shall be a close relative of the petitioner, who will file affidavit to the effect that the petitioner shall not indulge in such activity further and if he indulges, then, the deponent must inform the Court about the indulgence of the petitioner and the Court below, itself, shall proceed to cancel the bail bond of the petitioner.
