JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.
The allegation against the petitioners is that they along with several F.I.R. named accused persons as well as unknown persons attacked on the police party and got released one co-accused, Bakhori Yadav who was caught by the police party in Chand P.S. Case No. 107 of 2015 and in that course, they assaulted the police personnel as a result of which they sustained injuries. Moreover, having more or less similar allegation, co-
Patna High Court Cr.Misc. No.11243 of 2016 (2) dt.10-03-2016 2/2 accused, Suresh Yadav and five others have already been granted privilege of bail by this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Chand P.S. Case No. 118 of 2015.
