Petitioner apprehends arrest in connection with Khagaria (Chitragupta Nagar) P.S. Case No. 7 of 2020 registered for the offence punishable under sections 363, 365, 328, 323, 342, 325, 379/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has committed no offence as alleged in the first information report and he has falsely been implicated in the present case. The present first information report has been lodged after three days of the alleged occurrence without there being any plausible explanation for the delay. Patna High Court CR. MISC. No.14715 of 2021(6) dt.14-02-2022 2/2 information report and in his statement under section 164 Cr. P.C. are completely different. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria (Chitragupta Nagar) P.S. Case No. 7 of 2020 subject to the conditions laid down under section 438(2) Cr.P.C.
