JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-307, 379 & other minor sections of the Indian Penal Code.
There is specific allegation against the petitioner that he assaulted the informant by means of Mungari, as a result of which, the informant sustained two grievous injuries and one simple injury. It appears from Annexure-2 to this petition that the informant sustained one grievous injury on his chest. Therefore, considering the allegation, levelled against the petitioner as well as submission of the parties, I am not inclined to release the petitioner on bail at least, at this stage and accordingly, his prayer for bail in connection with Sangrampur
Patna High Court Cr.Misc. No.12437 of 2016 (2) dt.18-03-2016 2/2 P.S. Case No. 182 of 2015 pending in the court of learned 14th Additional Chief Judicial Magistrate, East Champaran at Motihari stands rejected.
