The petitioner seeks bail in Muzaffarpur P.S. Case No. 150 of 2019, registered for the offences punishable under Sections 387/506 of the Indian Penal Code.

The informant alleged that on 12.07.2019 at about 10.16 p.m., a person namely, Gopal Thakur called him from mobile no. 8877748794 and he handed over the mobile to one another person namely, Raushan Kumar Mishra (petitioner), who demanded a ransom of Rs. 2,50,000/- from the informant and on non-fulfillment of that, he threatened the informant. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case due to business rivalry. Petitioner has never demanded any ransom

Patna High Court CR. MISC. No.3348 of 2020(3) dt.20-03-2020 2/2 from the informant, hence, no case is made out against the petitioner, under Section 387 and 506 of the Indian Penal Code. Petitioner is in custody since 28.11.2019.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate (Railway), Sonpur (Saran) in connection with Muzaffarpur P.S. Case No. 150 of 2019, subject to the conditions:- (i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, his bail bond shall be liable to be cancelled by the court below.

(ii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (Prabhat Kumar Singh, J) vinita/- U T
