The petitioner seeks regular bail in Baikunthpur P.S. Case No. 285/2018, registered for the offences punishable under Sections 302, 201, 120(B) and 34 of the Indian Penal Code. Petitioner is a lady.

In the written report it is alleged that brother of the informant Ram Singh @ Rajan Singh was called by Sima Kumari on telephone. He went after informing that he is going to the house of Harendra Mahato to take meal. The brother of informant did not return. Thereafter, informant went to the house of Harendra Mahato with co-villagers, but did not find anybody. The informant heard sound from the backside of the house of Harenda Mahato. The informant went towards that side

Patna High Court Cr.Misc. No.66 of 2019(2) dt.18-01-2019 2/2 and found 09 to 10 persons were dragging dead-body of his brother after putting a rope around his neck with intention to conceal the evidence. It is further alleged that in the torchlight petitioner has identified this petitioner and other accused persons named in the F.I.R.

Learned counsel for the petitioner has submitted that petitioner is mother of Sima Kumari. Petitioner has been implicated in this case because she is mother of Sima Kumari. Petitioner is in custody since 17.11.2018 having clean antecedent.

Considering the facts and circumstances of the case and the fact that in the written report there is no specific allegation of overt act against this petitioner, prayer of the petitioner for grant of bail is allowed. Let the petitioner abovenamed, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Gopalganj in connection with Baikunthpur P.S. Case No. 285/2018, subject to the condition that both the bailors will be close relative of the petitioner.
