The petitioner seeks bail in Kathaiya P.S. Case No. 243/2018, instituted for offence under Section(s) 37(c) of the Bihar Prohibition and Excise Act, 2016 read with Sections 25(1b)a, 26 and 35 of Arms Act. It is alleged in the written report that one country made pistol and one cartridge were recovered from possession of this petitioner.
It is mentioned in para 3 of bail petition that four other cases of Excise Act are pending against this petitioner. It has been submitted on behalf of petitioner that all the cases have been lodged by same informant.
Petitioner is in custody since 04.09.2018.
Patna High Court Cr.Misc. No.99 of 2019(2) dt.18-01-2019 2/2 Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Kathaiya P.S. Case No. 243/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. The petitioner will file affidavit at the time of release that he would not indulge himself in such type of activity in future. In the event, he is found indulged in such type of activity, his bail bond will liable to be cancelled.
