JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2020 This is an application for grant of anticipatory bail in connection with Bhagwan Bazar P. S. Case No. 78 of 2018 disclosing offences under Sections 341, 323, 324, 307, 114, 504/34 of the Indian Penal Code.
Petitioner is not named in the F.I.R. During the investigation his name transpires and there are specific allegation against other accused persons in the F.I.R. Case is of under Section 302 and other Sections of IPC.
Submission of the learned counsel for the petitioner is that only because of that he happens to be the brother of coaccused Avinesh Kumar Singh, he has named in the F.I.R and that Avinesh Kumar Singh has been granted privilege of anticipatory bail, by a Co-ordinate Bench of this Court, vide
Patna High Court CR. MISC. No.2513 of 2020(2) dt.24-01-2020 2/2 order dated 18.07.2019 passed in Criminal Misc. No. 23309 of 2019.
Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Saran, Chapra, in connection with Bhagwan Bazar P. S. Case No. 78 of 2018.
